terms for using and buying from calijosh

These Terms & Conditions govern your use of calijosh.com and purchases of CaliJosh products. By using this website or placing an order, you agree to these Terms. If you do not agree, do not use the site or place an order.

products and availability

CaliJosh makes and sells small-batch food products. Product descriptions, ingredients, packaging, availability, and photographs may be updated from time to time. We try to present products accurately, but minor variations in appearance, texture, color, or packaging can occur with small-batch products.

We may limit quantities, discontinue products, reject or cancel an order, or correct pricing or product information when reasonably necessary. If we cancel a paid order before shipment, we will refund the amount paid for the canceled items.

orders, pricing, and payment

Prices displayed on calijosh.com are in U.S. dollars. The product pages state when shipping and handling is included in the displayed price. Applicable taxes, if any, may be calculated or collected during checkout. Payment is processed through Stripe on a Stripe-hosted checkout page.

An order is not accepted until payment is successfully processed and the order is accepted for fulfillment. You are responsible for providing accurate billing, contact, and shipping information.

california shipping only

CaliJosh currently ships products only to California addresses. Orders submitted with a shipping address outside California may be canceled and refunded. See our Shipping & Returns Policy for additional details.

food, ingredients, and allergens

Read the product label and allergen information before consuming a CaliJosh product. Current granola contains tree nuts, including almonds and pecans, and may contain traces of gluten from shared production facilities. Ingredient and allergen information shown on the product label should be reviewed before consumption, particularly if you have food allergies, sensitivities, or dietary restrictions.

Do not consume a product if its packaging appears materially damaged, opened, contaminated, or otherwise unsafe. Contact us at hello@calijosh.com if you receive a product in that condition.

returns and refunds

Returns, replacements, cancellations, and refunds are governed by our Shipping & Returns Policy, which is incorporated into these Terms.

acceptable use

You may use this website only for lawful purposes. You may not interfere with the site, attempt unauthorized access, introduce malicious code, scrape or use the site in a manner that materially burdens its infrastructure, impersonate another person, submit fraudulent orders, or use CaliJosh content in violation of intellectual-property or other applicable rights.

intellectual property

The CaliJosh name, logos, graphics, product presentation, website design, photographs, text, and other original site content are owned by or licensed to CaliJosh and are protected by applicable intellectual-property laws. Except as permitted by law, you may not copy, reproduce, distribute, sell, or create derivative commercial uses of that content without permission.

third-party services and links

The site may link to third-party services, including Stripe. Those services are operated independently and may have their own terms and privacy policies. CaliJosh is not responsible for a third party's systems, content, or practices, except to the extent responsibility cannot lawfully be disclaimed.

disclaimers

To the maximum extent permitted by applicable law, the website and its content are provided on an "as available" basis without warranties beyond those that cannot lawfully be excluded. Nothing in these Terms excludes any warranty, remedy, or consumer protection that applicable law makes non-waivable.

limitation of liability

To the maximum extent permitted by applicable law, and except for personal injury, product-liability claims, fraud, willful misconduct, violations of law, or other liability that cannot lawfully be limited, CaliJosh's aggregate liability arising from a particular order or your use of the website will not exceed the amount you paid to CaliJosh for the order giving rise to the claim.

To the maximum extent permitted by applicable law, CaliJosh will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the website or a commercial dispute concerning an order, where such damages may lawfully be excluded.

indemnification

To the extent permitted by law, you agree to indemnify and hold CaliJosh harmless from third-party claims, liabilities, losses, and reasonable costs arising from your unlawful misuse of the website, fraudulent conduct, infringement of another person's rights, or material violation of these Terms. This section does not require you to indemnify CaliJosh for CaliJosh's own negligence, product defect, unlawful conduct, or other responsibility that cannot lawfully be shifted to you.

governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where another law must apply. Subject to any non-waivable consumer right to bring a claim elsewhere, disputes that may properly be brought in court will be brought in a state or federal court with jurisdiction in California.

changes, severability, and entire agreement

We may revise these Terms from time to time by posting an updated version and changing the effective date. If any provision is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. These Terms, together with the Privacy Policy and Shipping & Returns Policy, form the agreement governing your use of this site and purchases from CaliJosh, except for additional terms presented at checkout.
